AGREEMENT TO TERMS

These Terms of Use are a legally binding agreement between you and Gia B Design, LLC, doing business as Gia B Goods ("Gia B Goods," "we," "us," or "our"), an Oregon limited liability company based in Portland, Oregon. They cover your use of giabgoods.com and any purchases you make through it (the "Site").

By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. 

INTELLECTUAL PROPERTY

Everything on the Site, including our text, photographs, graphics, product names, logos, and designs, is owned by or licensed to Gia B Goods and protected by copyright and trademark laws. You're welcome to view, download, or print content for your own personal, non-commercial use. Please don't copy, reproduce, sell, or otherwise use our content or marks for any commercial purpose without our written permission.

USING THE SITE

By using the Site, you confirm that you are at least 18 years old or are using it with the involvement of a parent or guardian, that the information you provide is accurate and complete, and that you'll use the Site only for lawful purposes.

You agree not to:

  • Use the Site for any illegal, fraudulent, or unauthorized purpose

  • Interfere with or disrupt the Site, its security features, or the networks connected to it

  • Upload or transmit viruses or other harmful code

  • Use bots, scrapers, or other automated tools to access the Site or collect data from it

  • Collect other visitors' information or email addresses to send unsolicited messages

  • Copy, reverse engineer, or resell any part of the Site or its content

  • Impersonate another person or misrepresent your connection to anyone

  • Harass, abuse, or threaten us or anyone else using the Site

We may restrict or end access to the Site for anyone who violates these Terms.

PRODUCTS + WELLNESS DISCLAIMER

Our products are handcrafted in small batches from plant-based ingredients, so color, scent, and texture may vary slightly from batch to batch and from the photos on the Site. We work to describe every product accurately, but we can't guarantee that every detail or screen display will be exact. Products are subject to availability and may be discontinued at any time.

Our skincare, body care, and fascia care products are intended for general wellness and self-care. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and the information on the Site is not medical advice. Statements on the Site have not been evaluated by the Food and Drug Administration.

Please read each product's full ingredient list before use, especially if you have sensitivities or allergies, and patch test new products on a small area of skin first. Stop using any product that causes irritation. If you are pregnant, nursing, have a medical condition, or have questions about whether a product or fascia tool is right for you, please check with your healthcare provider first. Fascia care tools should be used gently and as directed, never on broken skin, injuries, or areas of pain, and are not a substitute for care from a licensed professional. You use our products at your own discretion.

ORDERS, PRICING, AND PAYMENT

We accept the payment methods shown at checkout. All prices are in U.S. dollars, and applicable sales tax and shipping fees are added at checkout. By placing an order, you authorize us to charge your chosen payment method for the total amount.

Prices may change at any time. If a product is listed at an incorrect price or with incorrect information due to an error, we may correct it and cancel or refund the order, even after it has been placed. We may also refuse or limit any order, including orders that appear to be placed by resellers or distributors, and we'll let you know and refund any payment if we do.

SHIPPING + RETURNS

We ship to the addresses entered at checkout, and delivery times are estimates. Once your order is handed to the carrier, we can't control delays, but we're always happy to help track down a package. Please review our Shipping and Return Policy on the Site before placing an order; it explains how returns, exchanges, and damaged items are handled.

REVIEWS + SUBMISSIONS

We love hearing how our products fit into your rituals. When you leave a review, please share your honest, firsthand experience, and keep it free of profanity, hateful or discriminatory language, personal information about others, and anything false or misleading.

We welcome all honest reviews, positive and negative. We may remove reviews that contain offensive or abusive language, spam, personal information, content unrelated to our products, or content that violates these Terms, but we will not remove a review simply because it is critical.

By posting a review or sending us feedback, ideas, or photos, you give us permission to use, display, and share that content, including on our Site, emails, and social media, without payment to you. We may include your first name and last initial with a review.

DISCLAIMERS

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the Site will always be available, uninterrupted, or error-free, or that any product will produce a particular result for you.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, GIA B DESIGN, LLC, ITS OWNERS, AND ITS CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT OR ORDER. Some states don't allow certain limitations, so some of these may not apply to you.

INDEMNIFICATION

You agree to defend and hold harmless Gia B Design, LLC, its owners, and its contractors from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or products, your violation of these Terms, or content you submit to us.

GOVERNING LAW + DISPUTES

These Terms are governed by the laws of the State of Oregon. If a concern comes up, please email us first so we can try to make it right. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Multnomah County, Oregon.

TERMINATION

These Terms apply for as long as you use the Site. We may suspend or end access to the Site for anyone who violates them, without notice.

CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. Continuing to use the Site after an update means you accept the revised Terms.
